Terms of Service

These Terms of Service govern your use of services provided by Masons Paving and Sealcoating. By requesting a quote, scheduling a service, or authorizing work to be performed, you agree to these terms. Please read them carefully.

Masons Paving and Sealcoating is a paving and asphalt maintenance company serving Essex County, Middlesex County, and Southern New Hampshire. We provide sealcoating, crack sealing, pothole repair, line striping, and asphalt paving for residential and commercial customers. We operate seasonally from mid-April through late October.

All quotes provided by Masons Paving and Sealcoating are based on information available at the time of the estimate. Quotes are valid for 30 days from the date issued unless otherwise noted. Final pricing may be adjusted if site conditions differ materially from what was observed during the estimate, or if the scope of work changes at the customer's request.

A quote does not constitute a guarantee of scheduling availability. Work will be scheduled upon acceptance of the quote and subject to crew and equipment availability.

By accepting a quote and scheduling service, you agree to provide Masons Paving and Sealcoating reasonable access to the work area on the scheduled date. This includes ensuring that vehicles, personal property, and obstructions are cleared from the area prior to our arrival.

We will make every reasonable effort to complete work on the scheduled date. Weather, equipment issues, or other unforeseen circumstances may require rescheduling. We will notify you as promptly as possible if a reschedule is necessary.

Payment is due upon completion of work unless otherwise agreed to in writing prior to the start of the job. We accept cash, check, and major credit cards. Invoices not paid within 30 days of the completion date may be subject to a late fee.

For larger commercial projects, a deposit may be required prior to scheduling. This will be communicated at the time of quoting.

We ask that you provide at least 48 hours notice if you need to cancel or reschedule a confirmed appointment. Cancellations made with less than 48 hours notice may result in a cancellation or mobilization fee, particularly if equipment and crew have already been dispatched or prepared for the job.

Masons Paving and Sealcoating stands behind the quality of our work. Warranty terms vary by service type and will be provided in writing at the time of service completion. Warranties cover defects in materials and workmanship and do not extend to damage caused by subsurface or base issues, snow plow damage, third-party alterations, normal wear and tear, or conditions outside our control.

No warranty is implied beyond what is stated in writing. Warranty claims must be submitted by contacting us directly at 617-821-3993.

Asphalt and sealcoating work is weather dependent. We reserve the right to delay or reschedule work due to rain, low temperatures, or other conditions that would negatively affect the quality of the finished product. We will not perform work that we believe will result in an inferior outcome due to conditions outside our control.

Sealcoating requires dry pavement and temperatures above 50 degrees Fahrenheit. Newly applied sealcoat should not be exposed to rain or vehicle traffic for a minimum of 24 to 48 hours after application.

The customer is responsible for ensuring that the work area is accessible and free of obstructions on the scheduled service date. The customer is also responsible for notifying us of any underground utilities, irrigation systems, drainage features, or other subsurface elements that may be affected by the work. Masons Paving and Sealcoating is not liable for damage to unmarked or undisclosed subsurface features.

Masons Paving and Sealcoating's liability for any claim arising out of services provided shall not exceed the total amount paid by the customer for those services. We are not liable for indirect, incidental, or consequential damages of any kind.

We are not responsible for pre-existing conditions in pavement, base material, or subsurface areas that affect the performance or longevity of our work.

We may update these Terms of Service from time to time. Any changes will be reflected on this page with an updated effective date. Continued use of our services after changes are posted constitutes your acceptance of the updated terms.

These terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes arising from services provided by Masons Paving and Sealcoating shall be subject to the jurisdiction of the courts of Essex County, Massachusetts.
